Bad Check!

During all this mess, Code Blue Racing was forced to pay the bad check that SR(Vicarious Motorsports) wrote to SCOA for the entry fees for our race in February. I understand that we were indirectly responsible for it, but in a court of law, SR(Vicarious Motorsports) would be. What do you guys and gals feel I should do? What recourse do I have? I have already been told by SRPops prior to the race this weekend that it would be taken care of sometime in the future. Well our future came this weekend for Amanda and myself, we had to pay out of our pocket, before we could race at this event. To add insult to injury we have been told we can only pay with cash now at any APBA race we attend. Thank you SR(Vicarious Motorsports)! The funny this is I can't even make out the scribble (signature) of who signed the check.

On the up side Amanda took home a 1st place overall for the weekend and I brought home second.

Congrats on the 1st place. I'm sorry to hear about the bounced check problem. It's made you guys lose a little face...I'd be pissed about that.

I would take them to court. No questions asked. Twisted Evil If you wrote a "bad check" to the grocery store, walmart, cosco or somewhere like that, you better believe you'd have to show your face in court or the clerks office to pay it off. Or in NC the bad check program or whatever they call it.
I also remember SR mentioned (a short time ago) something about possibly sueing one of the SR to get parts back because he was talking smack. That deal could work both ways.
And besides that February?, like "they" didn't know the check was no good WTH? You signed a contract no? That contract could work boths ways if you tag the right attorney.
Yes, I can be the wicked witch in the east and would be if it was me or us.

Congrats on the top finishes.
As to the check, not sure of the laws in AZ, but with the check coming across state lines it might change things a little.The check was written by one person to another person, making you the "third party" involved.The bad check would be considered criminal law as a "worthless check" and would have to be pursued by the person that it was written to.
You, however, covering the check is a different story. You should be able to file a lawsuit to get your money back, and also file for breech of contract.I don't know how much the check amount was, but I would do it if it was only $ 10.Be sure to ask for any and all legal expenses.
As for having to pay in cash in the future, that could also be part of the lawsuit, because your reputation has been damaged. I would, however, get a letter from my bank and send to the higher powers of the sanctioning body, explaining what happened, and see if they will release the "cash only" restriction they have placed on you.
Hope this helps,consult with an atty. in your state to get the exact facts.

Well congrats on the win...as far as the check goes I dont know what to tell you. Unfortunately i fyou go through the trouble of going to court the fees would be more than the check. Then you still ar eresponsible for collection part of it.
I think tha tthis a shame to hear and I think unfortunate that the answer you recieved was so vague, you would think that he would have made aphone call to keep your name clear.

Jason, you and Jim are the ones responsable for this check. What are you going to do ? You know you can call me at any time to discuss it. What is going on with SR ?
